In November 2025, attorney John E. Cutler of the Cutler Law Office, P.A., attended an intensive, multi-day training focused on DUI breath testing and trial strategy, hosted by the National College of DUI Defense (NCDD) in Phoenix, Arizona. This was not a basic overview or a routine continuing education course. It was a deep dive into the science behind breath alcohol testing and how that science can – and should – be challenged and explained in DUI cases.

DUI cases often turn on breath test evidence. To properly defend someone accused of DUI, it’s not enough to know the law. A DUI defense attorney must understand how breath testing actually works, where it can go wrong, and how to clearly explain those problems to a judge or jury.

How Breathalyzer Tests Really Work (and Why That Matters in DUI Cases)

The first portion of the course focused on the science of breath testing. The instructors for this portion included nationally recognized scientific experts. They explained how breath-testing devices are designed to estimate blood alcohol concentration and the scientific assumptions they rely on to produce a number.

One of the most important lessons is that breath test results are not as simple – or as certain – as they are often presented in court. The course addressed common misconceptions in DUI cases, including the idea that breath testing machines are infallible or that a printed number automatically equals guilt.

We examined how physiological factors, scientific assumptions, and real-world testing conditions can all affect breath test results. These are issues that are not always obvious to jurors – and sometimes not even fully understood by the courts – but they can make a critical difference in a DUI defense.

Hands-On Breath Test Training: Seeing the Machines Up Close

Unlike many legal seminars, this course included hands-on experience with breath-testing devices. Participants worked directly with several machines, learning how they are assembled, put into service, and calibrated.

We examined common machine issues, maintenance concerns, and potential sources of error that can affect test results. This kind of practical experience is invaluable. It moves the discussion beyond theory and provides real insight into how breath tests are actually administered and how problems can arise during the process.

Turning Breath Test Science into an Effective DUI Defense

Once the scientific foundation was established, the focus shifted to trial skills and courtroom strategy. This portion of the seminar was taught by highly experienced DUI trial attorneys. We were broken into small groups to learn how to identify weaknesses in breath-test evidence and turn them into a clear, persuasive defense.

The course covered every stage of a DUI trial, including:

  • Identifying scientific and procedural issues that support a not guilty verdict
  • Incorporating breath test problems into jury selection
  • Carrying those issues through opening statements and closing arguments
  • Effectively cross-examining breath test experts
  • Directly examining defense experts to explain complex science in plain language

The goal was not simply to understand the science, but to learn how to communicate that science in a way jurors can understand and trust.

Learning from National Leaders in DUI Defense

As noted above, the seminar was taught by a combination of scientific experts and some of the most respected DUI defense attorneys in the country. Their combined perspectives reinforced an important truth: effective DUI defense requires both technical knowledge and strong trial advocacy skills.
